Family Petitions

Bringing Loved Ones Home Through Family Petitions

U.S. immigration law allows citizens and lawful permanent residents to sponsor family members for permanent residency through a system of two core categories—Immediate Relatives and Family Preference. Whether you’re applying for a spouse or a more distant relative, understanding how these pathways work is key to reuniting your family.

Two Primary Paths: Immediate vs. Preference Categories

  • Immediate Relatives (IR): Close family members of U.S. citizens. No annual visa limits.
  • Family Preference (F1–F4): More distant relationships. Limited by yearly visa caps.

Unlimited Visas for Immediate Relatives

  • IR-1: Spouse of a U.S. citizen
  • IR-2: Unmarried child under 21
  • IR-3: Orphan adopted abroad
  • IR-4: Orphan to be adopted in the U.S.
  • IR-5: Parent of a U.S. citizen (21+)

Limited Visas For Extended Family

  • F1: Unmarried sons and daughters of U.S. citizens (23,400/year)
  • F2: Spouses and unmarried children of LPRs (114,200/year)
  • F3: Married sons and daughters of U.S. citizens (23,400/year)
  • F4: Siblings of U.S. citizens (65,000/year)
Note: Grandparents, aunts, uncles, cousins, and in-laws cannot sponsor a relative under current immigration law.

Understand Priority Dates and Wait Times

  • Priority date: The date USCIS receives your petition
  • Visas are issued in order of priority date—first come, first served
  • Wait times can range from months to several years, depending on category and country

Returning Residents: Special Immigrant Visas

  • LPRs who stay outside the U.S. for over 12 months may need a Returning Resident (SB) visa
  • Used when a long absence was beyond the applicant’s control
  • Allows lawful permanent residents to resume residency status without starting over
